If requested by the District Attorney, the workers’ compensation insurance company MUST withhold up to 25% of each compensation payment. At the time of settlement of your case, the district attorney will have filed a lien against your compensation. If you want a lump sum settlement, the district attorney will not be limited to 25% of the lump sum. The district attorney can take an amount equal to the unpaid and support obligation that has accrued since the beginning of your temporary disability. GET A SUPPORT MODIFICATION AS EARLY AS POSSIBLE TO AVOID HAVING A LARGE PART OF YOUR SETTLEMENT TAKEN BY THE DISTRICT ATTORNEY AT THE END OF YOUR CASE.
